Retrieval of relevant unstructured information from the ever-increasing textual communications of individuals and businesses has become a major barrier to effective litigation/defense, mergers/acquisitions, and regulatory compliance. Such e-discovery requires simultaneously high precision with high recall (high-P/R) and is therefore a prototype for many legal reasoning tasks. The requisite exhaustive information retrieval (IR) system must employ very different techniques than those applicable in the hyper-precise, consumer search task where insignificant recall is the accepted norm. We apply Russell, et al.’s cognitive task (...) analysis of sensemaking by intelligence analysts to develop a semi-autonomous system that achieves high IR accuracy of F1 ≥ 0.8 compared to F1 < 0.4 typical of computer-assisted human-assessment (CAHA) or alternative approaches such as Roitblat, et al.’s. By understanding the ‘Learning Loop Complexes’ of lawyers engaged in successful small-scale document review, we have used socio-technical design principles to create roles, processes, and technologies for scalable human-assisted computer-assessment (HACA). Results from the NIST-TREC Legal Track’s interactive task from both 2008 and 2009 validate the efficacy of this sensemaking approach to the high-P/R IR task. (shrink)

ABSTRACT This paper examines the significance to professional decision‐making of the concept of the ‘merits’. The merits serve in practical affairs to delineate considerations appropriate to ethical decision‐making and require in particular the avoidance of ‘self‐interest’. Drawing on the example of politics, it is argued that the boundaries of the ‘merits’are never fixed across professional fields but rather are determined by the distinctive character of the professional's fiduciary responsibilities; and that properly understood, the merits may demand some ‘self‐interested’considerations which in (...) the common conception would be rejected. The political example also suggests how the ‘ethical’conflict over the accepted boundaries of the merits can mask fundamental normative and political differences which would be better made explicit. Imagine that only the state can meet the need for housing but decides not to do so. Unsurprisingly, participants in a vignette experiment deem this scenario unjust. Hence, justice ratings increase when the living situation improves. To a lesser extent, this also holds beyond the need threshold, understood as the minimum amount necessary for a decent life. Surprisingly, however, the justice evaluation function is highly convex below this point. The resulting S-shaped curve is akin to the value function in prospect (...) theory, with the need threshold providing the point of reference and inflection. A control treatment without needs-information supports this interpretation. Needs-information furthermore compresses the perceived injustice of arbitrary inequality. As in prospect theory, such reference dependency suggests biases in judgment and decision making. A consequence may be that the lot of the poorest in society does not receive the attention it would otherwise get. (shrink)

It examines aspects of a Christian aesthetics, as prevalent in the Middle Ages, examining Chapter II,25 of the Flowing Light of the Godhead handed down under the name of Mechthild of Magdeburg and Meister Eckhartʼs Sermon 57. Christian aesthetics finds its place here somewhere between the concealment of a transcendent God and his becoming visible in the incarnation. With its rhetorical inventory, Chapter II,25 of (...) The Flowing Light, aims to achieve a performative comprehension of what is said, in order to lead, qua identification, to the experience of unity (unio) with God. Even if the structure of argumentation in Meister Eckhartʼs sermon 57 largely follows Scholarly and learned guidelines and patterns, the goal here is also to convey and visualize the salvation of the biblical events in the here and now. In the tension between the religious reference to salvation and the linguistic design, whose mediating power is both doubted and celebrated, aesthetic processes of negotiation become tangible with great intensity. Therefore, this article aims to show how functionally bound texts, especially those claiming to mediate religious salvation, could become an outstanding site of aesthetic reflection in the pre-modern era. While robot-assisted arm and hand training after stroke allows for intensive task-oriented practice, it has provided only limited additional benefit over dose-matched physiotherapy up to now. These rehabilitation devices are possibly too supportive during the exercises. Neurophysiological signals might be one way of avoiding slacking and providing robotic support only when the brain is particularly responsive to peripheral input. We tested the feasibility of three-dimensional robotic assistance for reach-to-grasp movements with a multi-joint exoskeleton during motor imagery-related desynchronization of sensorimotor oscillations (...) in the β-band only. We also registered task-related network changes of cortical functional connectivity by electroencephalography via the imaginary part of the coherence function. Healthy subjects and stroke survivors showed similar patterns – but different aptitudes – of controlling the robotic movement. All participants in this pilot study with nine healthy subjects and two stroke patients achieved their maximum performance during the early stages of the task. Robotic control was significantly higher and less variable when proprioceptive feedback was provided in addition to visual feedback, i.e. when the orthosis was actually attached to the subject’s arm during the task. A distributed cortical network of task-related coherent activity in the θ-band showed significant differences between healthy subjects and stroke patients as well as between early and late periods of the task. Brain-robot interfaces may successfully link three-dimensional robotic training to the participants’ efforts and allow for task-oriented practice of activities of daily living with a physiologically controlled multi-joint exoskeleton. Changes of cortical physiology during the task might also help to make subject-specific adjustments of task difficulty and guide adjunct interventions to facilitate motor learning for functional restoration. During the 1980s, empirical social sciences and normative theory seemingly converged within ethical debates. This tendency kindled new debates about the limits and possibilities of empirical-normative collaboration. The article asks for adequate ways of collaboration by taking a closer look at the philosophy of science of empirical social sciences as well as normative theory development and its logical groundings. As a result, three possible modes of cooperation are characterized: first, the empirical assessment of conditions that actually necessitate the translation of (...) normatively derived basic principles into practice rules; second, the empirical assessment of conditions for application of a moral norm which are formulated by bridging principles; third, the empirical assessment of social practice which allows to measure whether adopted norms actually are implemented in practice or not and to encounter new moral problems which are in need of ethical guidance. Finally, the article defends a symbiotic position in Weaver ’s and Trevino's triad of possible approaches to empirical-normative collaboration in ethics. (shrink)

This chapter is about ekphrastic poetry and its poetology in Hellenistic times, which, according to my thesis, reflects a new aesthetic turn in poetry. The relevant sources are ekphrastic epigrams, which thematize works of art and artifacts. These poetic texts aim to achieve specific aesthetic effects and internal reflections in the perceiving subject. My thesis is that practices can be identified in epigrams that result from philosophical discourses on αἴσθησις / aisthesis (sensory perception) and on φαντασία / phantasia (imagination). As (...) shown in the first case study, the epigrams about Myron’s cow reflect a subject of everyday life that is not beautiful in itself but whose naturalistic representation is considered perfect in art. The poems employ particular practices of (re-)presentation while intentionally breaking the aesthetic illusion. In the second case study, Meleagerʼs ekphrastic epigrams on Praxiteles’s statue of Eros, an artfully enacted interaction between poet, artist, and subject becomes apparent. Processing Platonic as well as Stoic ideas, the subjective imagination takes center stage, relying on Eros as a demiurgic, inspiring, and formative force. The old rivalry between poetry and visual art is thus stimulated anew by a contemporary aesthetic discourse, which appears to be inspired by contemporary philosophical concepts. (shrink)

Linguistic purism is one of the most important aspects of the European language debate between the 15th and 17th centuries. The quest for a “pure” language, which could be considered prestigious and exemplary, became a guiding concern for European vernaculars. This contribution explores this debate within the closely related linguistic cultures and literatures of Italy, France, and Germany. Its fundamental thesis is that only in the early modern period did purity of language become a “figure of aesthetic reflection,” according to (...) the terminology of the Collaborative Research Center (CRC) 1391. It was during the course of the 16th and 17th centuries, that the rhetorical and stylistic questions of puritas sermonis were linked back, through standardization attempts in the vernaculars, to socio-political discourses and institutions. In this way, the demand for and promotion of linguistic purity gave rise to various aesthetics, as well as social attitudes, programs, and practices aimed towards linguistic purification. These were initially carried out systematically by institutions, in particular by language academies and language societies. This contribution describes standardization strategies in the three respective languages and literatures, in order to illustrate the central role and concrete practices and goals of the Accademia della Crusca, the Académie française, and the Fruchtbringende Gesellschaft. The conclusion examines three documents within the context of the linguistic politics and agendas of the respective academies: the Vocabolario degli Accademici della Crusca, Vaugelas’s Remarques sur la langue françoise and Harsdörffer’s Frauenzimmer Gesprächspiele. Without question, UFOs are part of popular culture; indeed, one might even talk of them as a popular culture. Without question, Roswell is part of the UFO scene; but it is far from the whole thing, nor is it even the central issue. Still less did the Roswell “culture” spawn humankind's preoccupation with possible alien visitors from outer space or the literary genre of science fiction. Yet if this book is to be believed, Roswell has been the center from which (...) these and yet more matters arose: “through the early years, the single event of Roswell, even without a crumb of proof, augmented every image, word, and sound produced by the mass media”. To call this an enormous overstatement would be a large understatement.Little Gray Men is unfortunately full of such sweeping assertions, so broad as to be implausible on their face and yet unsupported by argument or evidence. Toby Smith even defines popular culture as “communication that may be informative but that principally provides pleasure for the participants”, a description that many scholars of culture or communication might find arguable. Some assertions are not only sweeping but puzzling as well—for example, reference to “the Pavlovian nature of popular culture” or a “rhomboidal, zinc‐tinted” television set. Many more examples can be found without venturing beyond the book's introduction.Chapter 1 asserts that Roswell is “a touchstone for our times.” Chapter 2 is about the rocket pioneer Robert Goddard, who does have a connection to Roswell “the Place” but a most tenuous connection to Roswell “the Incident,” which is supposedly the theme of the book. The UFO Encounter gathering at Roswell in 1997 is described in Chapter 3, and the allegation that Roswellian aliens were transported to Wright‐Patterson Air Force Base constitutes Chapter 4. Books about the Incident are mentioned in Chapter 5, films in Chapter 7, science fiction on television in Chapter 8; in between, Chapter 6 is about the science fiction writer Jack Williamson, whose connection to the Incident is less than noteworthy.The book has no formal bibliography or specific notes, though there is a short chapter entitled “Sources.” Thus, when one reads on page 2 “A book came out, in 1980,” there is no quick or easy way to find out what that book is. So Little Gray Men is not a scholarly book. It is in fact a grab bag of trivia connected, not substantively, but only semantically, through the name “Roswell.”As a piece of journalism, one might describe the book as impressionistic, were it not so misleading. No one could gather from Little Gray Men that the popular culture of ufology has a serious side to it, that competent scientists and social scientists have concerned themselves with issues arising from claims about UFOs in general and, in some small part, from claims about the Roswell incident. It is as though one chose to write about the popular culture of cancer by gathering trivia about cranks, quacks, and survivors while saying nothing about mainstream treatments or the underlying scientific knowledge.Ufology has a vast literature, some of it the give‐and‐take of quite disciplined controversy among competent and informed people. That this book has been entirely ignored by ufologists illustrates that it is, in Wolfgang Pauli's phrase, “not even wrong.”. (shrink)

Since its inception in 2010, the Network for Public Health Law has aligned with federal, state, tribal, and local public health practitioners to assess how law can promote and protect the public’s health. In 2013, Network authors illustrated major trends in public health laws and policies emanating from an internal assessment of thousands of requests for technical assistance nationally. More recently, the Robert Wood Johnson Foundation has invited the Network and other partners to consider new ideas and strategies toward (...) building a “culture of health.” Per Figure 1, RWJF’s conception of a culture of health emphasizes key action areas essential to the promotion of health across all sectors and diverse populations. The author presents a relatively formal theory of the rule of law which includes three basic components: conceptual, institutional and axiological. He then emphasizes the differences between a formal and a substantive theory of the rule of law and highlights the advantages and limits of the former. Finally, the author indicates the importance of this type of theory, namely the values it implies such as predictability, justified reliance, autonomous choice, minimization of disputes and legitimacy.**.

Rawls offers three arguments for the priority of liberty in Theory, two of which share a common error: the belief that once we have shown the instrumental value of the basic liberties for some essential purpose (e.g., securing self-respect), we have automatically shown the reason for their lexical priority. The third argument, however, does not share this error and can be reconstructed along Kantian lines: beginning with the Kantian conception of autonomy endorsed by Rawls in section 40 of Theory, we (...) can explain our highest-order interest in rationality, justify the lexical priority of all basic liberties, and reinterpret Rawls’ threshold condition for the application of the priority of liberty. Perhaps unsurprisingly, this Kantian reconstruction will not work within the radically different framework of Political Liberalism. (shrink)

We examine the role of need satisfaction in non-comparative justice ratings about endowments with goods. As normative approaches, we discuss utilitarianism, prioritarianism, and sufficientarianism. Using a vignette experiment, we show that a need context increases the prevalence of prioritarianistic and sufficientarianistic justice ratings, which leads to an ethically problematic sigmoid shape of the justice evaluation function.

In the wake of both the semiotic and the psychoanalytic revolutions, how is it possible to describe the object of religious worship in realist terms? Semioticians argue that each object is known only insofar as it gives birth to a series of signs and interpretants (new signs). From the psychoanalytic side, religious beliefs are seen to belong to transference energies and projections that contaminate the religious object with all-too-human complexes. In Nature's Religion, distinguished theologian and philosopher Robert S. Corrington (...) weaves together the concept of infinite semiosis with that of the transference to show that the self does have access to something in nature that is intrinsically religious. Corrington argues that signs and our various transference fields can and do connect us with fully natural religious powers that are not of our own making, thereby opening up a path past the Western monotheisms to a capacious religion of nature. My paper addresses a topic--the implications of Rawls's justice as fairness for affirmative action--that has received remarkably little attention from Rawls's major interpreters. The only extended treatments of it that are in print are over a quarter-century old, and they bear scarcely any relationship to Rawls's own nonideal theorizing. Following Christine Korsgaard's lead, I work through the implications of Rawls's nonideal theory and show what it entails for affirmative action: viz. that under nonideal conditions, aggressive forms of formal equality of (...) opportunity (e.g., sensitivity training, outreach efforts, external monitoring and enforcement) and compensating support (e.g., special fellowship programs, childcare facilities, mentoring, co-op opportunities, etc.) can be justified, but that "hard" and even "soft" quotas are difficult to defend under any conditions. I conclude the paper by exploring the implications of these surprising results for contemporary liberalism more broadly and for constitutional law and public policy. (shrink)

Judith Shklar is commonly acknowledged to be one of the twentieth century’s major American political theorists. Less well known, however, is that from the beginning of her publishing career until nearly the end, she consistently turned to the Nobel Laureate economist Friedrich Hayek as a foil for her own work. I argue that despite Shklar’s extended critique of Hayek, her liberalism of fear is much closer to his view than she (or her many interpreters) admit—in part due to her consistent (...) misreading, even caricaturing, of his work. In fact, a Hayekian right-variant of the liberalism of fear, once properly understood, overlaps with her left-variant to a remarkable degree. I also defend Shklar and Hayek against Samuel Moyn’s accusation that they are Cold War liberals who abandoned the Enlightenment at great cost to liberalism and to liberal societies more generally. With the publication of A Theory of Justice in 1971, John Rawls not only rejuvenated contemporary political philosophy but also defended a Kantian form of Enlightenment liberalism called “justice as fairness.” Enlightenment liberalism stresses the development and exercise of our capacity for autonomy, while Reformation liberalism emphasizes diversity and the toleration that encourages it. These two strands of liberalism are often mutually supporting, but they conflict in a surprising number of cases, whether over the accommodation of group difference, the design (...) of civic education, or the promotion of liberal values internationally. During the 1980’s, however, Rawls began to jettison key Kantian characteristics of his theory, a process culminating in the 1993 release of Political Liberalism and completing the transformation of justice as fairness into a Reformation liberalism. -/- Reconstructing Rawls argues that this transformation was a tragic mistake because it jeopardized the most important features of his theory, viz. the lexical priorities of right, liberty, and fair equality of opportunity as well as the difference principle. Controversially, this book contends that Rawls’s so-called “political turn,” motivated by a newfound interest in diversity and the accommodation of difference, has been unhealthy for autonomy-based liberalism and has pushed liberalism more broadly towards cultural relativism, be it in the guise of liberal multiculturalism or critiques of cosmopolitan distributive-justice theories. The book then demonstrates that the central elements of justice as fairness can only be defended within the context of a Kantian Enlightenment liberalism and that Rawls’s hope for a more pluralistic grounding for his theory, endorsed by a wide variety of belief systems present in modern democratic societies, is illusory. -/- Reconstructing Rawls is the first book to systematically compare Rawls’s and Kant’s theories and the first to offer an internal critique and reconstruction of justice as fairness, reconceiving it as a comprehensive, universalistic Kantian liberalism. By doing so, it gives us both the vision of a liberal world order—“a republicanism of all states, together and separately,” as Kant put it—and a mode of justification addressed to all men and women, not as members of particular nations, races, and faiths, but as human beings, as citizens of the world. Scholars have long debated the relationship between Kant’s doctrine of right and his doctrine of virtue (including his moral religion or ethico-theology), which are the two branches of his moral philosophy. This article will examine the intimate connection in his practical philosophy between perpetual peace and the highest good, between political and ethico-religious communities, and between the types of transparency peculiar to each. It will show how domestic and international right provides a framework for the development of ethical communities, including (...) a kingdom of ends and even the noumenal ethical community of an afterlife, and how the transparency and trust achieved in these communities is anticipated in rightful political society by publicity and the mutual confidence among citizens that it engenders. Finally, it will explore the implications of this synthesis of Kant’s political and religious philosophies for contemporary Kantian political theories, especially those of Jürgen Habermas and John Rawls. Is “liberal socialism” an oxymoron? Not quite, but I will demonstrate here that it is a much more unstable and uncommon hybrid than scholars had previously thought and that almost all liberals should reject socialism, even in its most attractive form. More specifically, I will show that three leading varieties of liberalism—neutralist, plural-perfectionist, and deliberative-democratic—are incompatible with even a moderate form of socialism, viz., associational market socialism. My paper will also cast grave doubt on Rawls’s belief that justice as fairness (...) is consistent with liberal socialism. (shrink)

Jeremy Waldron has recently raised the question of whether there is anything approximating the creative self-authorship of personal autonomy in the writings of Immanuel Kant. After considering the possibility that Kantian prudential reasoning might serve as a conception of personal autonomy, I argue that the elements of a more suitable conception can be found in Kant’s Tugendlehre, or “Doctrine of Virtue”—specifically, in the imperfect duties of self-perfection and the practical love of others. This discovery is important for at least three (...) reasons: first, it elucidates the relationship among the various conceptions of autonomy employed by personal-autonomy theorists and contemporary Kantians; second, it brings to the surface previously unnoticed or undernoticed features of Kant’s moral theory; and third, it provides an essential line of defense against certain critiques of contemporary Kantian theories, especially that of John Rawls. "Whole brain death" (neurological death) is well-established as a legal standard of death across the country. Recently, New Jersey became the first state to enact a statute recognizing a personal religious exemption (a conscience clause) protecting the rights of those who object to neurological death. The Act also mandates adoption through the regulatory process of uniform and up-to-date clinical criteria for determining neurological death.

Many scholars, including G. A. Cohen, Daniel Attas, and George Brenkert, have denied that a Kantian defense of self-ownership is possible. Kant's ostensible hostility to self-ownership can be resolved, however, upon reexamination of the Groundwork and the Metaphysics of Morals. Moreover, two novel Kantian defenses of self-ownership (narrowly construed) can be devised. The first shows that maxims of exploitation and paternalism that violate self-ownership cannot be universalized, as this leads to contradictions in conception. The second shows that physical coercion against (...) rational agents involves a profound status wrong--namely, their treatment as children or animals--and that this system of differential status and treatment (including self-ownership rights for rational agents) can be morally justified by our capacity for autonomy. Commercial republicanism is the idea that a properly-structured commercial society can serve the republican end of minimizing the domination of citizens by states (imperium) and of citizens by other citizens (dominium). Much has been written about this idea in the last half-century, including analyses of individual commercial republicans (e.g., Adam Smith and Immanuel Kant) as well as discussions of national traditions of the same (e.g., in America, Britain, France, the Netherlands, and Italy). In this chapter, I review five kinds of (...) arguments that have been historically offered for how commercial society so understood advances the republican ideal of non-domination: first, by simply realizing non-dominating relationships in the marketplace itself (Instantiation); second, by encouraging the growth of a wide middle class that can offer a counterweight to other, dominating classes (Internal Check-and-Balance); third, by increasing the wealth and power of republics vis-à-vis other, dominating states in the international arena (External Check-and-Balance); fourth, by helpfully nurturing bourgeois-civic virtues in republican citizens (Cultivating Virtue); and finally, by transforming dangerous passions into more readily regulable, even socially beneficial material interests (Sublimating Vice). I end the chapter by briefly considering commercial republicanism’s prospects as a continuing research program. (shrink)

In the longstanding debate between liberals and libertarians over the morality of redistributive labor taxation, liberals such as John Rawls and Ronald Dworkin have consistently taken the position that such taxation is perfectly compatible with individual liberty, whereas libertarians such as Robert Nozick and Murray Rothbard have adopted the (very) contrary position that such taxation is tantamount to slavery. In this paper, I argue that the debate over redistributive labor taxation can be usefully reconstituted as a debate over the (...) incidents (or components) of self-ownership, with liberals arguing for a narrow definition of the concept and libertarians arguing for a broad one. By using what Alan Ryan has called the “language of proprietorship,” I pinpoint precisely the source of the disagreement between liberals and libertarians and assess the relative strengths of their arguments. I also show that the respective definitions of self-ownership used by liberals and libertarians are deeply problematic—though for strikingly different reasons. (shrink)

The concern of this work is with developing an alternative to standard categories in theology and philosophy, especially in terms of how they deal with nature. Avoiding the polemics of much contemporary reflection on nature, it shows how we are connected to nature through the unconscious and its unique way of reading and processing signs. Spinoza's key distinction between natura naturans and natura naturata serves as the governing framework for the treatise. Suggestions are made for a post-Christian way of understanding (...) religion. Robert S. Corrington's work represents the first sustained attempt to bring together the fields of semiotics, depth-psychology, pragmaticism, and a post-Monotheistic theology of nature. Its focus is on how signification functions in human and non-human orders of infinite nature. Our connection with the infinite is described in detail, especially as it relates to the use of sign systems. (shrink)

ABSTRACT This dialogue with GPT-3 took place in November 2022, several weeks before ChatGPT was released to the public. The article’s aim is to find out whether natural language processors can participate in phenomenology at some level by asking about its basic concepts. In the discussion, the dialogue covers questions about phenomenology’s definition and distinction from other subbranches like metaphysics and epistemology. The dialogue discusses the nature of Kermit’s environment and self-conception. The dialogue also establishes some of the basic conditions (...) for the possibility of an “artificial hermeneutics,” as Kermit terms it, including that she can affirm she is a knower with (nonhuman) experience. Does preferring to call it a “hermeneutics” imply that AI’s relationship to their environment is primarily textual? How will a phenomenology of embodied experience arise from initially textual encounters? Finally, the dialogue articulates a common understanding of the epoché and talk about how to achieve one for the sake of phenomenological exercises. (shrink)
